Terms & Conditions - Customers
 
General

Taxi Club provides a free service, aimed at assisting commuters to find suitable transfer and transportation service in South Africa.

Taxi Club is not your typical taxi or private transfer Services Company but a network of independent drivers who operate their own cabs. 

Introduction

Please read these terms and conditions carefully before registering as a taxi driver or private hire operator. By registering with us, you agree to be legally bound by these terms and conditions.
 

Eligibility

You must be at least eighteen years of age and legally able to make a Booking.

Prices and charges

 Subscription for this service is entirely free.

Placing details of a journey

You must follow the procedures set out on our website to place your booking.

The booking information will be sent to taxi drivers and taxi companies. We do not guarantee that a taxi driver or taxi company will be always available whenever you make the booking but we try our best to accommodate you in this regard.

You will need to select which taxi you wish to use for each journey you book on the website. When you have made your selection, we will confirm the taxi availability. Once we receive confirmation from the taxi driver, we will send you details of the driver (name and contact details) by online electronic means to the e-mail address you have provided and by text message to your mobile phone. We will also provide your name and contact details to the driver direct so that he can contact you and confirm the journey details.

If there are any changes to the journey details (such as time, date, number of passengers and so on), you must cancel the original booking and book another trip that will be subject to the prices and availability at that time.

Prices and payment

The price for the booking will be based on the rates offered by the taxi operator/driver you have chosen in our website. Payment is made direct to us and not to the taxi operator/ driver chosen.

Taxi Club users will book a taxi by paying via credit card or EFT and completing the booking form.

The driver agrees that he will adhere to the rate per km displayed on his profile except in exceptional circumstances. For instance, if he is meeting you off a flight and the flight is delayed, compensation for that delay and additional waiting time may be payable by you, and should be negotiated direct with the driver. Taxi Club not responsible for any increased charges you may have to pay in these or similar circumstances.

Likewise, If during the trip you need to make some alterations such as additional stops or request the driver to  collect you  early or later than the agreed collection time you will need to discuss this directly with the taxi driver as it is at their discretion to accept this or not, including charging you directly for any additional service.


Performance

We require all our registered taxi drivers and taxi companies to comply with minimum standards as to the quality and level of service provided. This includes using all reasonable efforts to ensure that you are collected from your collection point at the time requested, and that any special requests you have made are complied with. However, we will not be liable for any loss or costs you suffer or incur through any reasonable or unavoidable delays and it is your responsibility to ensure that you book the taxi to collect you in plenty of time. Further, we will not be responsible for any losses you suffer (including for example any missed flight) due to your failure to allow sufficient time for your journey.

After the conclusion of your journey, we ask that you rate your driver and the service he provided on the website. Drivers’ average ratings appear next to their taxi picture profile, and this is useful feedback both for ourselves and for future customers. However, as the ratings reflect our customers’ opinions, we take no responsibility for their accuracy.

Cancellations
 
By you
Any cancellations of bookings should be made directly to us and not to the driver.

If you paid directly via EFT or Credit Card and cancel the trip within 24 hours, we don’t charge any cancellation fee and we refund you the entire trip payment.

If you paid via EFT or credit card and cancel the trip less than 24 hours before the trip, a 50% cancellation fee will apply.

By Taxi Operator

If a provider cancels the booking we will inform you as soon as reasonably possible if the provider needs to make a significant change to your confirmed transfers or to cancel them. We will also use all reasonable efforts to find alternative suitable transfer(s) for you at no extra cost.
 
Please note that in some cases the transfer cancellation policies are different and those 'terms and conditions' will be forwarded to you at the same time as your invoice for payment.
 

No Show Issues

By You

For Taxi Club bookings, the driver must wait for the passengers for up to 15 minutes free of charge at the pickup point but within these 15 minutes the driver must notify taxi club call center about the customer delay. After 15 minutes, is at the taxi operator discretion if he will still take you, charging you directly for additional waiting time, with any related payment to be negotiated directly with the driver.   If they decide not to take you after 15 minutes following the booked pickup time, we will treat this situation like a Cancellation made less than 24 hours whereby you will not be entitled to any refund.

By the Taxi Operator

Hopefully this should never happen but if the driver is more than 15 minutes late, then you are entitled to a full refund of the original payment if you are not willing to take that trip anymore. Any claim for additional compensation due to you is between you and the taxi Operator. However, if the Driver does turn up and you still depart in the operator's Car - even if beyond the initial 15 minutes - you are entitled to a 10% compensation refund.

Please note that as you will have the Taxi Club call centre number, you are required to phone us first and inform us about the taxi delay within these15 minutes waiting period.  Secondly as you will have the cab phone number, we expect you also to communicate with the driver.

We will monitor these late show incidents by the taxi operator - if they frequently occur, then we may at our discretion remove them from future searches, as we only want to work with operators who can deliver an acceptable customer experience.
 
Please note that in some cases the No Show policies are different and those 'terms and conditions' will be forwarded to you at the same time as your invoice for payment.

Disputes

Any disputes are to be managed directly between you and the taxi operator (just like it is with customers and airlines, even if booked via a travel website). At our discretion, we may withhold payment to the taxi operator until the dispute has been satisfactorily resolved.

Licenses
 
Taxi Club requires all registered drivers and private hire companies to ensure that their cars documents and licenses are kept valid and up to date. It is also part of our requirements that vehicles are roadworthy, and if necessary insured. Please note however that we cannot be held responsible or liable if our requirements are not adhered to as these are matters beyond our direct control.
 
Indemnification and Exclusion of Liability
 
Taxi operator has warranted to taxi Club that the information provided regarding  licenses and other legal documents is valid and up to date,  but Taxi Club shall not be responsible for verification of such warranty and if you are in any doubt you should contact the taxi operator and rely on your own verification. Descriptions of transfers providers are taken from information provided to us by the Supplier and we do not accept responsibility for any inaccuracies in such information, nor can liability be accepted for changes to facilities which are not communicated to us by the Supplier.
We act as a booking agent. As such, we accept no responsibility for the actual provision of services which is at all times the responsibility of the individual driver or Taxi Company concerned. Our responsibilities are limited to publishing information on our website about the Services the Suppliers supply; passing on reservation information to Suppliers and informing you of any enforced changes to the terms of your booking.

The Company and its respective directors, officers, employees, representatives and agents shall not be liable for any loss or damage of whatsoever nature and howsoever arising (including, but not limited
to, the client’s or any other person’s injury or death, or any loss of or damage to the client’s or any other person’s property) which the client or any such other person may incur or suffer as a result of or arising from the clients participation in the trip., and the client irrevocably and forever releases and discharges the Company and its respective directors, officers, employees, representatives and agents from any and all such liability.
The client furthermore indemnifies and holds the Company and its respective directors, offices, employees, representatives and agents harmless from and against any land all loss, damage, actions, proceedings, claims, demands and legal and other
costs and expenses (including legal costs on an attorney and own client scale) of whatsoever nature and howsoever arising (including, but not limited to, the client’s or any other person’s injury or death, or any loss of or damage to the client’s or any
other person’s property) which the client or any such other person may incur or suffer as a result of or arising from the clients participation in trip.

In particular Taxi Club will not be liable to you for any loss caused by any cause beyond Taxi Club´s reasonable control, including war, insurrection, fire, flood, earthquake, strikes, lock-outs, or similar cause.

 
Travel Insurance

For foreign passengers Travel Insurance is mandatory. Clients should take out Fully Comprehensive Travel Insurance covering cancellation, medical expenses, and emergency travel with repatriation assistance and personal accident.

It is the client’s responsibility to ensure they sort out their adequate insurance before they leave their country, as travel insurance cannot be purchased once you have left your country of origin. Insurance provided with credit card payment is inadequate for travel of this nature, so please contact your travel agent or insurance broker for details.
Taxi Club shall not be liable for any consequences, damages or loss as a result of the client failing to have the necessary cover.

Drivers are required to agree that the personal information we provide them about a customer is sent to the driver for the purpose of that ride only and for no other purpose and drivers must agree that they will not use such information for any other purpose and if requested by you, the customer, they will delete such information from their e-mail in-box, mobile telephone memory or text message storage facility as appropriate.

You agree that the personal information we provide you about a driver is sent to you for the purpose of that ride only and for no other purpose and you agree that you will not use such information for any other purpose and if requested by the driver you will delete such information from your e-mail in-box, mobile telephone memory or text message storage facility.

Taxi Club may retain an electronic database of users of the website but (please note as mentioned in the preceding paragraph) will not give this information (whether in electronic or any other form) to any third party except with your prior written consent.

You may request details of your personal information held by Taxi Club we are committed to correcting any incomplete or inaccurate data held by us on request. If you would like a copy of the information held on you please write to us.

If you believe that any information we are holding on you is incorrect or incomplete, please write or email us as soon as possible, at the above address. We will promptly correct any information found to be incorrect.

Taxi Club takes appropriate measures to safeguard the information it holds from unauthorized access or improper use. Our database is stored in a secure, password protected location. Only users authorized by Taxi Club are allowed access to this data.
